HP sells webOS operating system to LG Electronics

SAN FRANCISCO (Reuters) – Hewlett-Packard Co said on Monday it will sell the webOS operating system to South Korea’s LG Electronics Inc, unloading the smartphone software it acquired through a $ 1.2 billion acquisition of Palm in 2010.

LG will use the operating software, used in now-defunct Palm smartphones years ago, for its “smart” or Internet-connected TVs. The Asian electronics company had worked with HP on WebOS before offering to buy it outright.

Under the terms of their agreement, LG acquires the operating software’s source code, associated documentation, engineering talent, various associated websites, and licenses under HP’s intellectual property including patents covering fundamental operating system and user interface technology.

HP will retain the patents and all the technology relating to the cloud service of webOS, HP Chief Operating Officer Bill Veghte said in an interview.

“As we looked at it, we saw a very compelling IP that was very unique in the marketplace,” he said, adding that HP has already had a partnership with LG on webOS before the deal was announced.

“As a result of this collaboration, LG offered to acquire the webOS operating system technology,” Veghte said.

Skott Ahn, President and CTO, LG Electronics, said the company will incorporate the operating system in the Smart TV line-up first “and then hopefully all the other devices in the future.”

Both companies declined to reveal the terms of the deal.

LG will keep the WebOS team in Silicon Valley and, for now, will continue to be based out of HP offices, Ahn said.

HP opened its webOS mobile operating system to developers and companies in 2012 after trying to figure out how to recoup its investment in Palm, one of the pioneers of the smartphone industry.

The company had tried to build products based on webOS with the now-defunct TouchPad tablet its flagship product.

HP launched and discontinued the TouchPad in 2010, a little over a month after it hit store shelves with costly fanfare after it saw poor demand for a tablet priced on par with Apple’s dominant iPad.

WebOS is widely viewed as a strong mobile platform, but has been assailed for its paucity of applications, an important consideration while choosing a mobile device.

Big studios behind swag-fueled Oscar push

LOS ANGELES (AP) — Giant coffee table books, iPod Shuffles, signed letters from directors, even “Lincoln” turkey roasting pans. That’s just some of the largesse doled out by the studios to voters for awards presented earlier this season — each with the potential to influence the outcome of Hollywood’s most important awards, Sunday night’s Oscars.

Such gifts are strictly forbidden by the Academy of Motion Picture Arts and Sciences. But for studios, the stakes are high, and they’ve been creative in working around the rules to give their movies the best spotlight possible. A best picture win can boost a film’s commercial appeal and solidify relations with big-name actors and directors.

This year, top Oscar contenders “Argo” from Warner Bros. and “Lincoln” from Disney pitted two deep-pocketed rivals against each other in what some say was an unprecedented level of Oscar campaigning. There was even some targeted sniping about the films’ bending of historical facts.

Part of what’s behind the seemingly unrestrained lobbying is that this year, an unusually large number of best picture nominees are also doing well at the box office, giving the studios dry powder for their campaigns.

Six of the nine contenders for the top Oscar have reaped $ 100 million or more in ticket sales domestically, and collectively they’ve earned $ 309 million since the nominations Jan. 10, according to Hollywood.com. This record-setting “Oscar bump” dwarfs the $ 111 million the nine best picture nominees made between the nominations and the awards ceremony last year. It also trumps the season that 2009′s megahit “Avatar” was in the running, when 10 nominees brought in $ 204 million in bump.

That means there’s plenty of reason for studios to keep spending — even to the extent of papering the walls of the popular Beverly Hills restaurant Kate Mantilini with campaign posters, which conveniently tower over diners just a block from the motion picture academy itself.

“I have never seen such an assault in terms of stuff being sent to us,” said Pete Hammond, a member of the Broadcast Film Critics Association, which hosts the Critics Choice Awards, and a columnist for the Hollywood blog Deadline.com.

Hammond is one of several voters for the earlier awards where wins translate into momentum for Oscar hopefuls. They say their mailboxes were swamped with swag this year — all of it an attempt to reach the 5,800 academy members who vote on the Oscars, albeit through indirect means.

From the campaign of Steven Spielberg‘s “Lincoln,” members of the broadcast critics group say they received no less than four coffee table books, an intricately framed DVD for review purposes and even a hand-signed letter from Spielberg himself, thanking them for recognizing the film with so many nominations. Some awards voters also received “Lincoln” turkey roasting pans, according to an industry insider who spoke on the condition of anonymity because the person was not authorized to speak publicly about the matter.

The broadcast critics also received an iPod Shuffle, which retails for $ 49, containing the soundtrack to Universal Pictures’ “Les Miserables,” which is up for music and sound mixing awards.

Several voters said this level of giveaway was unusual, but then again, in recent times, well-funded major studios haven’t been that involved.

In the last two years, the movie industry’s top honor went to The Weinstein Co.’s “The Artist” and “The King’s Speech.” Previous to that, 2009′s winner was “The Hurt Locker,” whose backer Summit Entertainment was just starting to get its “Twilight” mojo and was yet to be flush with cash.

Before that it was Fox Searchlight’s “Slumdog Millionaire” and before that “No Country for Old Men” by Paramount Vantage — both smaller arms of major studios that have smaller marketing budgets than their larger siblings.

This year, the majors are back in the game in a big way. In addition to Warner’s “Argo” and Disney’s “Lincoln,” Sony Pictures is behind “Zero Dark Thirty,” 20th Century Fox is backing “Life of Pi” and Universal is the force behind “Les Miserables.”

While The Weinstein Co.’s “Silver Linings Playbook” is earning boffo business above $ 100 million in ticket sales following co-chairman Harvey Weinstein‘s familiar script of making the most of awards season, it appears that this year, the majors have studied up.

“Nobody ever did it besides Harvey, and now everybody’s done it this year,” said David Poland of MovieCityNews.com, which means more intense campaigning because there’s more money to spend.

One look at the release pattern of “Zero Dark Thirty” and it’s clear that Sony didn’t want to repeat what happened to “The Hurt Locker,” another Kathryn Bigelow-directed war film that despite its best picture win, made just $ 19 million in theaters worldwide. Part of the problem with “Hurt” was that it came out in June and was all but gone from theaters by the time the Oscar nominations rolled around.

Instead, “ZDT” showed in just a handful of theaters in December to qualify for the 2012 Oscars, but burst onto 3,000 theaters the day after the nominations in January, capturing the top spot at the box office that weekend.

“We designed our release campaign to take advantage of key dates in the awards season,” said Sony Pictures spokesman Steve Elzer. “With approximately $ 90 million in box office to date, the film has been a huge critical and commercial success and no matter how we do at the Oscar ceremony on Sunday, we couldn’t be more pleased with the film’s performance.”

Starting small and then going wide after the nominations is the “Playbook” that The Weinstein Co. has followed for years, although company co-chairman Harvey Weinstein denies the pattern.

“There is no playbook, there is no campaigning,” Weinstein said. “I have always said the most important thing is to get people to see the films and everything else is mostly fluff.”

Even films at the tail end of their box-office run are pumping up the volume. “Argo,” which came out in October, was heavily advertised by Warner Bros. ahead of the DVD release this Tuesday. The studio began selling digital downloads two weeks ahead of that. Fox followed a similar strategy for “Life of Pi.”

“Because these films are so strong, all the companies are buying (ads),” said Michael Parker, co-president of Sony Pictures Classics, whose film “Amour” is also up for best picture.

Critic Anne Thompson of Indiewire said this year’s extravagance is due to the fact that big studios have high hopes for their films. Amid her swag pile are “Wreck-It Ralph” plastic fists, a toy bow and arrow from “Brave,” and a printed page of the John Williams score from “Lincoln.”

“The factors here are a) the studios involved and b) big hit movies that had extra money,” she said. “And the fact you have a close race between two big studio movies. They have reason to believe they have a chance to win.”

On Twitter, a peanut gallery mocks the Oscars

NEW YORK (AP) — You can simply tune into the Oscars. Or you can watch them with the peanut gallery on Twitter.

While Hollywood parades in tuxedos and gowns, grandly celebrating itself, a freewheeling cacophony of quips and sarcasm — something like a digital, million-times multiplied version of those balcony Muppet onlookers, Statler and Waldorf — will provide a welcome and riotous counter-narrative to the pomp.

The second-screen experience is never better than on Oscar night, when a separate (and some might say superior) entertainment experience plays out on social media. The running commentary, in which comedians and others parody the glamorous stars and their sometimes laughable speeches, has become as central to the Academy Awards as the red carpet.

“Following the Oscars on Twitter is like watching the show with one hundred million of your drunkest friends,” says Andy Borowitz, the humorist and author who’s often been a standout tweeter on Oscar night. Last year, he succinctly summarized the previous two best-picture winners, “The King’s Speech” and “The Artist,” as “an English dude who couldn’t speak” and “a French dude no one could hear.”

Live tweeting major TV events, from the Super Bowl to the Grammy Awards, has become engrained in our viewing by now, forming a virtual water cooler that has boosted ratings. But the Academy Awards stream is particularly captivating because it provides an antidote to the on-screen, buttoned-down glamour. It’s as if there’s not an “SAP” button on your remote, but a “YUKS” one, bringing you play-by-play from some of the funniest people in cyberspace. Comedians assemble as if by duty.

“You gotta say something. Someone has to say something,” says comedian Billy Eichner. “To just stand by and watch it happen is almost too tense. It’s cathartic. You’ve got to just get it out on Twitter because if not, we’re all going to be bottled up thinking about how awkward Anne Hathaway made it for one billion people in real time. I don’t begrudge her the award; I’m just saying she’s a ridiculous person.”

As host of Funny or Die’s “Billy on the Street,” which airs on Fuse, Eichner aggressively and comically interviews passersby about pop culture. So he’s particularly adept at expressing all-caps mockery when it comes to the stars of Hollywood. In the awards circuit leading up to the Oscars, he’s zeroed in on Anne Hathaway, the odds-on favorite to win best supporting actress for her performance in “Les Miserables.”

In Hathaway, Eichner recognizes a great actress, but also a striving theater geek. Nothing is funnier, he says, “than the mix of ego and lack of self-awareness, like Jodie Foster’s Golden Globes speech.”

“Ultimately, it’s just fun because the whole thing is so ridiculous,” says Eichner. “It’s like, why not comment on it? What is it even there for other than to be commented on?”

The Oscars has become one of the biggest social media events of the year. Last year’s telecast at one point set a then-record for 18,718 tweets-per-second. A statuette could be handed out for a new award: most tweeted tweet. In 2011, that honor went to The Onion, which lamented: “How rude — not a single character from Toy Story 3 bothered to show up.”

Last year, “The Artist” may have won best picture, but Martin Scorsese’s “Hugo” easily bested it with 110,179 tweets to 78,509 for “The Artist,” according to Twitter metrics analyst TweetReach.

This year, the academy has partnered with Twitter to track the top categories with an index measuring the percentage of positive tweets about the nominees. Leading as of Tuesday wasn’t the favorite “Argo,” nor was it Steven Spielberg’s “Lincoln,” but rather David O. Russell’s “Silver Linings Playbook.” So if the film, widely considered the dark horse in the best picture race, wins on Sunday, Twitter will have predicted it.

Mark Ghuneim, chief executive of social media measurement firm Trendrr, says that during the Oscars, Twitter is “‘Mystery Science Theater 3000,’ for real,” referring to the cult TV show in which a man and two robot sidekicks wisecrack their way through B-movies.

“It’s really like you’ll never watch TV alone ever again, if you don’t want to,” says Ghuneim. “It’s a natural evolution in television and that’s why it’s so prevalent.”

With real-time data from services like Trendrr, the Oscar conversation can be tracked, revealing which moments resound and provoke audiences. Last year, Angelina Jolie’s leg-baring pose as a presenter immediately put Twitter in hyper-drive, spawning parody accounts from the perspective of her right leg.

It’s such moments where Twitter becomes Oscar’s dance partner. Viewers celebrate with — and chortle at — Hollywood’s self-seriousness, combining together for a TV experience greater than the sum of its parts.

When the 85th annual Academy Awards air Sunday on ABC, countless comedians and others at home will be ready on their mobile phones and laptops with tweets to skewer.

“I just pray we all survive Anne Hathaway’s acceptance speech,” says Eichner. “And, to be honest, I have my doubts.”

Sony set to make pre-emptive strike on Microsoft with PS4

TOKYO (Reuters) – Sony Corp is expected to showcase a new PlayStation console on Wednesday in a pre-emptive strike against Microsoft Corp’s bid to make its Xbox the world’s leading hub for household entertainment.

The rare PlayStation event in New York comes amid industry speculation that Microsoft is set to unveil the successor to its Xbox 360, which beats the seven-year-old PlayStation 3′s online network with features such as voice commands on interactive gaming and superior connectivity to smartphones and tablets.

“Their focus is on establishing a beachhead for the next generation of consoles, and that’s what February 20 is all about,” said P.J. McNealy, CEO and founder of Digital World Research. “The reality is they have been playing catch-up.”

Pushing ahead of Microsoft’s Xbox and Nintendo Co Ltd’s new Wii U could help Sony revive an electronics business hurt by a dearth of hit gadgets, a collapse in TV sales and the convergence of consumer interest around tablets and smartphones built by rivals Apple Inc and Samsung Electronics Co Ltd.

Tablets and smartphones already account for around 10 percent of the $ 80 billion gaming market. Those mobile devices, analysts predict, will within a few years be as powerful as the current slew of game-only consoles.

After six years, Sony PlayStation sales are just shy of Xbox’s 67 million installed base and well behind the 100-million selling Wii, analysts said.

A lackluster launch in November of the Wii successor, the Wii U, gives Sony a chance to focus on toppling Microsoft as all three battle the encroachment of casual gaming on tablets and smartphones. Nintendo cut its sales target to 4 million machines from 5.5 million for the year ending March 31.

STREAMING

Microsoft’s answer to the casual gaming threat has been software that gives users extra content and allows them to surf the Internet from their mobile devices. The Xbox already streams Netflix and ESPN and links to tablets and smartphones using Windows or Apple’s iOS and Google Inc’s Android. Sony’s PS3 online network has lagged.

“For Sony, they have to come out and make this PlayStation event the definitive statement of why gamers need to adopt the PlayStation 4 or PlayStation Orbis or whatever they end up calling it,” said Greg Miller, PlayStation executive editor at video game site IGN.com.

Sony’s purchase in July of U.S. cloud-based gaming company Gaikai for $ 380 million hints that the Japanese company will pursue a similar streaming strategy to Microsoft. Sony, industry watchers say, may also offer an expanded range of free games to counter the threat from casual gaming.

Sony, which under its CEO Kazuo Hirai is focusing on gaming, mobile devices and cameras, needs a hit product. But by betting on a PS3 successor, Hirai, whose most profitable business is life insurance, risks deepening consumer electronic losses as he will have to sell consoles at below the manufacturing cost to gain market traction.

That choice is made harder because the other two pillars of Hirai’s new Sony – cameras and mobile – are losing money.

Sony expects to post a $ 1.4 billion operating profit in the current fiscal year. Yet, much of that rebound is gains from offloading real estate, including $ 1.1 billion for its New York headquarters.

The PlayStation event in New York starts at 2300 GMT (1800 EST).

Is the Facebook Hack Part of a Bigger Spy Threat?

In the latest admission from a major company that it had been hacked, Facebook announced in a blog post on Friday afternoon that its “systems had been targeted in a sophisticated attack” and that “Facebook was not alone,” which immediately raised the cyber-espionage question of the moment: Was China behind this one, too? High-profile disclosures of months-long Chinese malware attacks from The New York Times and The Wall Street Journal raised the public stakes late last month, but the FBI, the Obama administration, and private security experts are monitoring what is a much wider espionage campaign against major American organizations — and Facebook, which appears to have been hacked late last month or in early February, could very well be its latest victim.

RELATED: China May (or May Not) Be Behind the Twitter Hack

Facebook does not detail where the malware compromise was initiated in its blog post, and company spokespeople are telling journalists it “won’t comment on hack origins.” But there is an important admission in the official post: “Facebook was not alone in this attack. It is clear that others were attacked and infiltrated recently as well.” That sounds awfully familiar to Twitter’s hacking announcement from another Friday evening this month, which some speculated had to do with China because of Twitter’s nod to the Times and the Journal. In its own blog post, Twitter said, “We do not believe it was an isolated incident. The attackers were extremely sophisticated, and we believe other companies and organizations have also been recently similarly attacked.” Facebook said it shared details with other possibly compromised companies—maybe Twitter was one of them? On the technical side, both Facebook and Twitter also mentioned a Java browser plug-in exploit, which may point to a connection between the hacks, even though 250,000 of Twitter’s accounts were affected and none of Facebook’s were.

RELATED: 83 Million Facebook Users Are Not Real People

It remains unclear if the Facebook attack has anything to do with the Chinese cyber-espionage campaign against high-profile U.S. companies, publications, websites, and more. There is another key word in Facebook’s admission — “sophisticated” — that makes the hack seem high-level enough. And per Facebook’s spokesperson, the attack “didn’t reach the legal threshold for user notification,” so they did have to even say anything. Neither did the Times or the Journal, both of which mentioned an ensuing FBI investigation in their admissions. Facebook also says it has handed over the case to law enforcement officials, Facebook Chief Security Officer Joe Sullivan told Ars Technica’s Sean Gallagher. This week, after President Obama issued an executive order and talked about cyber-security threats in his State of the Union address, major companies started sharing hack-attack information with more federal investigators.

RELATED: Chart: Google+ Hit 10 Million Users 50 Times Faster Than Facebook

Sullivan, the Facebook security boss, goes on to say that the Facebook hack “looked like a new campaign that wasn’t linked to previous Advanced Persistent Threat activities,” referring to the cyber-security term for espionage that targets governments and big companies. So maybe this is isolated and not part of the wave of Chinese cyber threats. Or maybe the “sophisticated” Chinese spying operation just has a fancy new hacking technique to add to its trail of malware malfeasance. But if Facebook’s new trouble is related to the Twitter hack, one would think the pattern would “appear to be related” to something, right? Guess we’ll have to see which big company comes clean next.

Newark mayor says beating, witness silence are “evil”

(Reuters) – Newark Mayor Cory Booker on Wednesday condemned the failure of witnesses to alert police after seeing a young man forced to strip naked and whipped over a $ 20 debt – violence revealed only after a cell phone video went viral on the Internet.

The two and a half minute video of the beating, which took place in Newark in August, got 40,000 views on YouTube before it was removed from the website, according to the Star-Ledger newspaper, which posted it on its own site.

“We have strong reason to believe there were others who saw this crime happen” but said nothing, never calling 911 or alerting police, the mayor said at a news conference on Wednesday to announce arrests in the case.

“In the face of evil, those who remain quiet are participants in that evil,” Booker said.

The video shows the victim complying with a man’s orders to strip naked, admit he owes $ 20 and repeatedly say “(It’s a) dog eat dog world.” The man then whips the victim, using a belt borrowed from another man, the video shows. Laughter from those watching the beating is heard throughout the video.

“This is not who we are. We are Newark, New Jersey. We do not tolerate this level of cruelty, of callous disregard for the dignity of humanity,” Booker said at the press conference.

Four people responsible for “this heinous, vicious, cruel crime” were recently apprehended and charged with robbery, assault and other crimes, Booker said.

Charged in the violence were Ahmad Holt, 22, who is believed to have carried out the whipping, Raheem Clark, 31, who is believed to have supplied the belt, Jamaar Grey, 23, accused as the cameraman, and Nicole Smith, 25, according to Booker’s office.

Newark, eight miles from Manhattan and New Jersey’s largest city, was once a thriving manufacturing center, but in recent decades it has battled an image of urban blight and high crime.

Since becoming mayor in 2006, Booker – a likely candidate for U.S. Senate next year – has made crime reduction a central priority. In March 2010, Newark experienced its first murder-free month since 1944.

But since then, amid cuts to the police force, crime has remained a significant problem in the city.

Telenor ramps up investments to support shift to data

OSLO (Reuters) – Mobile telecoms firm Telenor expects to accelerate investments in data and digital services this year as customers flock to its higher margin products, it said on Wednesday.

Telenor, which has around 150 million customers in Europe and Asia, will continue to roll out its third generation (3G) service in Thailand and fibre network in Norway to take advantage of “exploding” demand, and could also invest in 3G services elsewhere in Asia and in Denmark.

“The world is going all out on data. There are new digital concepts on every corner. It will be all about data in the future,” Chief Executive Jon Fredrik Baksaas told Reuters.

“People are becoming more dependent on data access; I compare it to electricity, people will take it for granted,” Baksaas said after the firm published quarterly results and released its initial 2013 guidance.

The transition to data, particularly in Thailand and Norway, the firm’s biggest markets, could push capital spending to between 12 and 14 percent of revenues this year from 12 percent in 2012, Baksaas said.

The shift to data, along with smaller losses in India, will allow Telenor to improve margins this year and the firm sees its earnings before interest, taxes, depreciation and amortization (EBITDA) margin widening to 34 percent from 32 percent.

The margin increase and a record 20 billion crown ($ 3.64 billion) cash flow in 2012 gives Telenor ample cash and it plans to pay a record dividend of 6 crowns per share after the previous year’s 5 crowns, it said.

UPSIDE

“We believe few investors will argue with the company’s decision to accelerate investment to support growth and the excellent returns in robust markets where demand for smartphones and data is accelerating,” Nomura said in a note to clients.

“The case for generating a positive return on this type of investment is more secure,” it said, maintaining a buy rating on the stock.

At 0942 GMT, Telenor shares were 2.2 percent higher at 121.7 crowns, outperforming a 0.1 percent fall by the broader telecom index.

Still, Morgan Stanley said the upside was limited given that Telenor has outperformed the telecom index by 30 percent over the past year and its valuation at 6 times it EBITDA puts it above the sector’s ratio of 5.

Fourth-quarter results, though short of expectations, had only a muted impact on valuation, particularly as they contained several one-off items, analysts said.

Analysts said they would be watching out for further clarity on Telenor’s Indian operations, as it may still seek to buy further licenses, or plans for its stake in Russia-focused Vimpelcom.

Monster Worldwide reports loss; exits Brazil, Mexico & Turkey

(Reuters) – Online recruitment company Monster Worldwide Inc, which is up for sale, reported a quarterly loss and said it had exited its businesses in Brazil, Mexico and Turkey.

The company also said it sold its China operations to Saongroup, a Dublin-based recruitment firm, and took a 10 percent stake in the combined business.

Monster said in November it would sell its money losing business in China to focus on its core North American and European businesses.

Monster has been hurt by weak job markets in the United States and Europe, which generate the lion’s share of its revenue, as well as growing competition from social networking sites.

The parent of Monster.com retained Stone Key Partners and Bank of America Merrill Lynch in March 2012 to review strategic alternatives including a sale of the company.

Monster reported a net loss of $ 73 million, or 66 cents per share, in the fourth quarter, from $ 10.9 million, or 9 cents per share, a year earlier.

The company recorded pre-tax charges of $ 23 million during the quarter ended December, and said it expects additional charges in the range of $ 27 million to $ 37 million in the first half of 2013.

Excluding items, the company earned 8 cents per share.

Revenue dropped 10 percent to $ 211.2 million.

Monster’s shares have dropped about a fourth since the company said it was reviewing strategic alternatives. They closed at $ 5.85 on the New York Stock Exchange on Wednesday.

Zynga 4Q loss narrows as game maker cuts costs

NEW YORK (AP) — Online games company Zynga said its loss narrowed in the latest quarter even though revenue was largely unchanged as the company cut expenses by laying off workers, closing offices and shutting down poorly performing games.

The results exceeded Wall Street’s muted expectations, and Zynga Inc.‘s battered shares increased nearly 7 percent in after-hours trading after the release of the results. After a difficult 2012 in which Zynga saw its stock price decline by 75 percent, CEO Mark Pincus called 2013 a “pivotal transition year” for the company as it seeks to cut costs further and broaden revenue sources, especially from mobile games.

Zynga went public in December 2011 with a lot of promise. Games such as “FarmVille” and “CityVille” were popular on Facebook, as the social media company was itself preparing for a highly anticipated initial public offering of stock.

But Facebook’s stock stumbled, and Zynga’s tumbled with it. Demand for Zynga’s games weakened, and investors were worried both about Zynga’s overreliance on Facebook for its revenue and signs that the two were growing apart. Zynga’s stock ended 2012 at $ 2.36, well below the IPO price of $ 10.

Zynga responded by announcing in October that it was cutting about 5 percent of its full-time workforce of roughly 3,200 employees. The San Francisco company also killed 13 older games and closed development studios in Boston and elsewhere.

Those cuts helped.

Zynga said Tuesday that it lost $ 48.6 million, or 6 cents per share, in the October-December period. That compares with a loss of $ 435 million, or $ 1.22 per share, in the same period a year earlier. Zynga began trading publicly on Dec. 16, 2011, and was privately held for most of the 2011 quarter.

Zynga’s revenue was largely unchanged at about $ 311 million. But it was well above analysts’ average estimate of $ 250 million, as polled by FactSet.

Zynga cut fourth-quarter expenses by two-thirds, to $ 274 million from $ 798 million.

Though its fortunes have faded, Zynga is still the most popular maker of games on Facebook. As of the end of the year, it had five of the top 10 games played on the world’s largest social networking site. “FarmVille 2,” which launched in September, performed well — the company said it was its most successful game launch in two years.

Zynga said it had 298 million active users each month on average in the fourth quarter, up 24 percent from 240 million a year earlier. But that’s down 4 percent from 311 million in the third quarter of 2012.

Like Facebook, Zynga is trying to position itself as a mobile company as people spend more time on smartphones and tablet computers. The company said it had 72 million monthly players on mobile devices.

“Mobile, however, remains a more fragmented experience. Despite the incredible growth in mobile gaming, it’s still hard for any of us to find people to actually play with,” Pincus said in a conference call with analysts. “We’re amazed that the number one way our ‘Words With Friends’ players find new opponents in their games is through the ‘random’ button. We know we can offer them something more compelling than that.”

Zynga’s chief operating officer, David Ko, said in an interview that growing the company’s paying mobile user base is “part of a long-term strategy for us”

“Two years ago, about 20 people were focusing on mobile,” he said. “Today we have almost the entire company focused on (the) mobile opportunity.”

For the current quarter, Zynga said it expects an adjusted loss of 5 cents to 4 cents per share and revenue of $ 255 million to $ 265 million. Analysts were predicting a loss of 1 cent per share and revenue of $ 268 million.

Shares climbed 19 cents, or 6.9 percent, to $ 2.93 in after-hours trading after gaining 18 cents to close at $ 2.74 during the regular session. Zynga’s stock has traded from $ 2.09 to $ 15.91 in the past 52 weeks.

iPad mini supply finally catching up with demand

Like other new mobile products Apple (AAPL) has launched in recent years, the company’s iPad mini has been in short supply ever since it was released this past November. The sleek device added a new, lower price point to Apple’s tablet portfolio and some analysts believe it will soon be more popular than Apple’s full-size iPad. While demand remained strong through the holidays, Apple managed to improve iPad mini supply and get shipping times for new orders placed in Apple’s online store ahead of the holidays down to 1 week. Now, shipping quotes are down to 1-3 business days, marking the best turnaround time Apple has seen since launching the new device. BGR reviewed the iPad mini last November and called it Apple’s best tablet yet.

Estonian pleads guilty in U.S. court to Internet advertising scam

NEW YORK (Reuters) – An Estonian man pleaded guilty on Friday in U.S. federal court for his role in a massive Internet scam that targeted well-known websites such as iTunes, Netflix and The Wall Street Journal.

The scheme infected at least four million computers in more than 100 countries, including 500,000 in the United States, with malicious software, or malware, according to the indictment. It included a large number of computers at data centers located in New York, federal prosecutors said.

Valeri Aleksejev, 32, was the first of six Estonians and one Russian indicted in 2011 to enter a plea. They were indicted on five charges each of wire and computer intrusion. One of the defendants, Vladimir Tsastsin, was also charged with 22 counts of money laundering.

In U.S. District Court in Manhattan on Friday, Aleksejev pleaded guilty to conspiracy to commit wire fraud and conspiracy to commit computer intrusion. He faces up to 25 years in prison, deportation and the forfeiture of $ 7 million.

The scam had several components, including a “click-hijacking fraud” in which the malware re-routed searches by users on infected computers to sites designated by the defendants, prosecutors said in the indictment. Users of infected computers trying to access Apple Inc’s iTunes website or Netflix Inc‘s movie website, for example, instead ended up at websites of unaffiliated businesses, according to the indictment.

Another component of the scam replaced legitimate advertisements on websites operated by News Corp’s The Wall Street Journal, Amazon.com Inc and others with advertisements that triggered payments for the defendants, prosecutors said.

The defendants reaped at least $ 14 million from the fraud, prosecutors said. However, Aleksejev’s lawyer, William Stampur, said in court on Friday that Aleksejev has no assets.

Estonian police arrested Aleksejev and the other Estonians in November 2011. One other Estonian, Anton Ivanov, has been extradited, and the extradition of the other four is pending, according to the U.S. Attorney’s office in Manhattan. The Russian, Andrey Taame, remains at large, according to the U.S. Attorney’s office.

Aleksejev told Magistrate Judge James Francis he assisted in blocking anti-virus software updates on infected computers. Francis asked Aleksejev if he knew what he was doing was illegal.

“I thought it was wrong,” Aleksejev said in broken English after a long pause. “But of course I didn’t know all the laws in the U.S.”

Francis set a tentative sentencing date of May 31 for Aleksejev.

The case is USA v. Tsastsin et al, U.S. District Court in Manhattan, No. 11-00878.

China May (or May Not) Be Behind the Twitter Hack

You may not have heard, but roughly 250,000 Twitter accounts may have been compromised by hackers. There’s a theory that — if you read between the lines — Twitter is implying the Chinese are to blame for compromising their security.

RELATED: The Chinese Want to Know Why Their News Is on Twitter and They Aren’t

Twitter revealed that roughly a quarter million accounts may have been compromised by hackers in a blog post Friday evening. (A classic Friday evening news dump if there ever was one; they got a $ 10 billion valuation the same day.)

RELATED: A Punk Prince, Women in the Military, a New Tennis Controversy

Bandits might have made away with “usernames, email addresses, session tokens and encrypted/salted versions of passwords – for approximately 250,000 users.” They think. A Twitter representative stressed to the Verge that they’re still investigating; there’s a chance we’re all safe.

RELATED: World Languages Mapped by Twitter

But was China behind it all?! That’s an emerging theory. We don’t know who was behind it. Twitter doesn’t say directly. None of the usual suspects have claimed ownership of the attack. (Yet.)

RELATED: The Good, the Bad, and the Fuzzy of Twitter’s New Censorship Rules

But Twitter mentions the New York Times and Wall Street Journal hacks in their opening paragraph, apropos of nothing, really. It could mean the company was just trying to show they’re not alone in being targeted — look at these bullies picking on these other kids, too. Or it could mean they’re subtly implying China is behind it all.

RELATED: Did the Berlin Wall’s Fall Save China?

The last paragraph in Twitter’s statement is where the theory really gets its legs. Emphasis ours:

This attack was not the work of amateurs, and we do not believe it was an isolated incident. The attackers were extremely sophisticated, and we believe other companies and organizations have also been recently similarly attacked. For that reason we felt that it was important to publicize this attack while we still gather information, and we are helping government and federal law enforcement in their effort to find and prosecute these attackers to make the Internet safer for all users.

So, did they do it? These sophisticated hackers who targeted other companies and organizations sure sounds like they’re implying it was China.

Was it China in the basement with the Cheetos and Red Bull and impressive coding skill? We don’t know for sure, but we’re definitely looking for any and every clue we can find.

Netflix CEO fights for the right to post company milestones on Facebook

It may not seem like the most pressing matter in an era of massive financial scandals, but the Securities and Exchange Commission has decided to go after Netflix (NFLX) CEO Reed Hastings for posting information about Netflix company milestones on his Facebook (FB) page. According to Bloomberg, the SEC believes that Hastings’ Facebook post, which announced that Netflix users had watched more than 1 billion hours of content over the company’s streaming service, may have violated regulations requiring that such information must be disclosed “through a press release on a widely disseminated news or wire service, or by ‘any other non-exclusionary method’ that provides broad public access.”

[More from BGR: BlackBerry doesn’t need to catch up with Android and iOS overnight, it needs to live to fight another day]

But despite being served with a Wells Notice for the post late last year, Bloomberg reports Hastings isn’t backing down from his belief that he has the right to share this kind of company information over Facebook.

[More from BGR: New leak details two more unannounced HTC smartphones]

“I wasn’t setting out to set an example,” Hastings told Bloomberg this week. “I was sharing something to these 200,000 people [who follow his Facebook feed]. I’m not going to back down and say it’s inappropriate. I think it’s perfectly fine. Sometimes you’re just the example that triggers the debate.”

Bloomberg notes that after the SEC sent a Wells Notice to Hastings, there have been “calls for the SEC to broaden its rules to allow social media such as Facebook and Twitter to be used to communicate to investors.”

3 Things That Still Worry Me About BlackBerry

BlackBerry put on a pretty good show on Wednesday when it revealed the Z10 and the Q10, its first new smartphones in a year and a half. The demos were crisp, and the new BlackBerry 10 software looked clever. At the very least, it seems that BlackBerry has finally joined the modern smartphone era.

But despite my interest in BlackBerry’s new phones, I’m still worried about the future of the platform, and not merely because it’s been off the radar for a while. Looking at what BlackBerry did and didn’t announce, and what reviewers are saying about the product, gives me a few big reasons for concern:

Apps, Both Present and Future

BlackBerry deserves credit for having lots of apps out of the gate–more than 70,000, the company says–including some important ones like Twitter, Facebook, Angry Birds and The New York Times. Still, there are some big names missing from the list, including Netflix, YouTube, Spotify and Instagram. You can’t expect a new platform to have everything right away, though, so I don’t want to judge BlackBerry’s current app count too harshly.

It’s the future that I’m really worried about. What happens when the next Instagram comes out, and becomes a sensation on the iPhone and Android? Will BlackBerry be like Windows Phone–that is, just an afterthought in the minds of up-and-coming app developers? The good news is that Android apps are relatively easy to port to BlackBerry 10 (in fact, roughly 40 percent of those 70,000 launch apps are simple ports, ReadWrite notes), so RIM just has to convince developers to make a relatively small effort. We’ll see if they do.

Never Neglect Maps

The consensus among BlackBerry Z10 reviews is that its Maps app is subpar. The Verge complained about inaccurate data, and said the software couldn’t reliably find local businesses. CNet bemoaned a lack of features, such as walking directions, transit maps and street views. Apparently the software doesn’t even let you jump into the Maps app by tapping on an address or map in the web browser. That’s just basic stuff. At least the Maps app includes voice-guided turn-by-turn directions.

In any case, having a good mapping service isn’t just about telling you where to go. It’s about using your location to deliver useful information. Google Now, for instance, can warn you about traffic before your commute home, and Apple‘s Passbook can call up a boarding pass when you get to the airport. These days, a really good standalone Maps app is only part of the equation, and BlackBerry doesn’t even have that yet.

Voice Commands and Virtual Assistants

BlackBerry has added voice commands in its new phones, but the list of supported actions is paltry compared to what Android and the iPhone offer. You can’t ask for movie times, the weather forecast, directions, or things to do. You can’t tell the phone to start playing music, answer a trivia question, calculate numbers or set reminders.

You may argue that it doesn’t matter, that most people don’t rely too heavily on voice commands to begin with. I think that will change as these virtual assistants become faster and support more types of queries. They’ll also become more useful in automobiles–in fact, some car makers are now starting to integrate Siri–and they may some day play a big role in wearable computing, allowing you to communicate by voice when your phone is just out of reach. It’s still early days for this kind of technology, but Apple and Google already have a huge head start. BlackBerry, by comparison, is just getting started.

I’m not saying the new BlackBerry phones are no good, or that no one should use them. Like I said before, the software has some clever ideas, such as the Hub that combines all communications into one area, and the Balance feature that acts as a separate login for business use. But the smartphone industry moves quickly, and BlackBerry’s period of rebuilding has taken its toll in a few key areas. As with before, it’s going to be hard for the company to catch up.

Facebook slumps as mobile ad growth fails to impress

(Reuters) – Shares of Facebook Inc were set to open 7 percent lower on Thursday as a surge in fourth-quarter mobile advertising revenue failed to live up to Wall Street’s high expectations.

Three brokerages downgraded the stock of the No. 1 social network, which has struggled to develop a full-fledged mobile advertising business.

Facebook has long established itself as one of the most important websites, but investors have worried that until the company’s mobile advertising strategy takes off, revenue growth will remain shaky.

The company reported a better-than-expected fourth-quarter profit on Wednesday and said its mobile advertising revenue doubled to $ 306 million, suggesting it was making inroads into handheld devices such as smartphones and tablets.

Investors were looking for at least $ 350 million in mobile advertising revenue, Piper Jaffray analyst Gene Munster said in a note to clients.

“While the trajectory of mobile growth may not be as steep as some investors were hoping, the theme of mobile as the future of Facebook remains intact,” he said.

BMO Capital Markets analyst Daniel Salmon, who downgraded the stock to “market perform” from “outperform”, however said Facebook’s 2013 stock performance would not be dictated by its ability to generate mobile ad dollars.

He said new catalysts were necessary to drive Facebook’s stock price up.

Facebook’s stock, which has lost over a quarter of its value since its botched debut in May, were down at $ 29.08 in premarket trading. The shares closed at $ 31.24 on the Nasdaq on Wednesday.

Yandex puts mobile app blocked by Facebook on hold

MOSCOW (Reuters) – Russian internet company Yandex has put an experimental application that allows users to search social networking sites from mobile devices on hold after it was blocked by Facebook.

Facebook, which launched its own search tool earlier this month, blocked the Wonder app three hours after its launch on January 24 for U.S. users.

The application allows users to look for recommendations on, for example, music or restaurants based on information from their friends on social network sites.

Facebook believes Wonder violates its policies, which state that no data obtained from Facebook can be used in any search engine without the company’s written permission, Yandex said on Wednesday, adding access to Facebook would not be restored.

“Since this access was revoked, we decided to put our application on hold for the time being,” the Russian firm said, adding it would consider partnership with other social networks and services.

Existing Wonder users are still able to search in Instagram, Foursquare and Twitter, a Yandex spokeswoman said, but marketing and further development of the application is on hold.

Children’s magazine promotes adult video games

LONDON (Reuters) – A British magazine distributed by a joint venture of Conde Nast and Hearst Corporation and aimed at primary school children has been featuring images of adult-rated video games.

The most recent issue of Cool Kidz, which is published by privately-owned LCD Publishing, contained images of five games that carried age ratings of 18 years, under the European gaming industry’s PEGI rating scheme.

Screenshots appeared as double-page spreads, for use as posters, and were reproduced in spot-the-difference and other puzzles. Earlier issues also had images from 18- and 16-rated games.

Children’s campaigners said the images reflected a growing problem of young children being exposed to violent video games, thereby increasing the chance they start playing them earlier.

It also highlighted what some critics describe as an apparent gap in regulation of children’s magazines since LCD does not appear to have broken any law or industry rule.

LCD Publishing, which is based in Exeter, southwest England, said it took its responsibilities to young readers seriously.

“We censor the images we use to ensure that there is no blood or apparent body damage,” owner Allen Trump said in an emailed statement.

He said the images used were suitable for children 12 or older, although he added the magazine was targeted at children up to 12 years.

The pictures printed depicted life-like computer generated images of men carrying weapons including assault rifles, Bowie knives, an axe, an anti-tank weapon and pistols.

The images showed explosions but not the visceral, bloody combat or scenes of a sexual nature for which the games are frequently criticized by parents’ groups and women’s rights advocates.

Cool Kidz is distributed by Comag, which is controlled by privately-owned U.S. magazine publishers Conde Nast, owners of Vogue magazine, and the Hearst Corporation, owner of Cosmopolitan magazine.

All three groups declined repeated requests for comment.

London-based Comag is one of the largest magazine distributors in the UK with annual turnover of around 230 million pounds ($ 360 million), according to its most recent accounts.

FREE PROMOTION

Trump said LCD downloaded the game images from the Internet although he was also occasionally approached by public relations firms seeking coverage of their clients’ games.

Games publishers regularly post images on their websites, for use by online and print publishers, thus helping create awareness of their game.

Games firms contacted by Reuters said they were unaware Cool Kidz, which has been published for seven years, had been using their images.

The adult games Cool Kidz featured included Hitman: Absolution, Call of Duty Black Ops II, Assassins Creed III, Farcry 3 and Dishonored.

Representatives for Japan’s Square Enix, publisher of the Hitman series, privately-owned Bethesda Softworks, publisher of Dishonored, and Ubisoft Entertainment, publisher of Assassins Creed III and Farcry 3, said they opposed the use but declined to say whether they would take any legal action against LCD.

Call of Duty publisher Activision declined to comment.

Alison Sherratt, senior vice-president of teachers union ATL, said publishers and government needed to do more to limit children’s’ exposure to games.

“It puts peer pressure on children .. If they see these images, it gives them the idea it’s ok, it’s all right to play these games,” she added.

A spokeswoman for the Advertising Standards Authority said games companies could not advertise 18 rated games in children’s magazines and a spokesman for the Video Standards Council (VSC), the UK affiliate of PEGI, said its rules also prohibited this.

However, since the images were not paid-for advertising, or supplied to Cool Kidz by the games publishers, these rules do not apply.

The Press Complaints Commission can adjudicate on complaints against magazines but only in respect of its members. LCD is not one.

The Office of Fair Trade and the Professional Publishers Association, trade group for magazine publishers, said they were unaware of any bodies that had regulatory powers over the content of children’s magazines.

Apple reportedly prepping new 128GB fourth-gen iPad

It isn’t the “next big thing” Apple (AAPL) investors are said to be waiting for as the company’s share price continues to plummet, but Apple is reportedly prepping a new iPad that will be its first iOS device to pack more than 64GB of storage. 9to5Mac reports that Apple has a new fourth-generation iPad SKU that will soon hit the shelves at one of its retail partners’ stores. Details are slim but the site says its source noted the presence of the word “ultimate” next to the new iPad’s description in the retailer’s system, leading 9to5Mac to speculate that the new model will feature 128GB of internal memory, adding a fourth storage option to Apple’s full-size iPad arsenal. The 128GB iPad listed in the retailer’s system reportedly features both Wi-Fi and cellular connectivity options. A purported image from the “high-profile” retailer’s inventory system follows below.

Facebook Profile May Expose Mental Illness

A person’s Facebook profile may reveal signs of mental illness that might not necessarily emerge in a session with a psychiatrist, a new study suggests.

“The beauty of social media activity as a tool in psychological diagnosis is that it removes some of the problems associated with patients’ self-reporting,” said study researcher Elizabeth Martin, a psychology doctoral student at the University of Missouri. “For example, questionnaires often depend on a person’s memory, which may or may not be accurate.”

Martin’s team recruited more than 200 college students and had them fill out questionnaires to evaluate their levels of extroversion, paranoia, enjoyment of social interactions, and endorsement of strange beliefs. (For example, they were asked whether they agreed with the statement, “Some people can make me aware of them just by thinking about me.”)

The students also were asked to log onto Facebook. They were told they would have the option to black-out parts of their profile before some of it was printed out for the researchers to examine.

“By asking patients to share their Facebook activity, we were able to see how they expressed themselves naturally,” Martin explained in a statement. “Even the parts of their Facebook activities that they chose to conceal exposed information about their psychological state.”

Participants who showed higher levels of social anhedonia — a condition characterized by lack of pleasure from social interactions — typically had fewer Facebook friends, shared fewer photos, and communicated less frequently on the site, the researchers found.

Meanwhile, those who hid more of their Facebook activity before presenting their profiles to researchers were more likely to hold odd beliefs and show signs of perceptual aberrations, which are irregular experiences of one’s senses. They also exhibited higher levels of paranoia.

“However, it should be noted that participants higher on paranoia did not differ from participants lower in paranoia in terms of the amount of personal information shared,” the researchers wrote in their study detailed Dec. 30, 2012, in the journal Psychiatry Research. That finding suggests this group might be more comfortable sharing information in an online setting than in the face-to-face interactions with the experimenter.

The researchers said information culled from social networking sites potentially could be used to inform diagnostic materials or intervention strategies for people with mental health issues.
